On May 16, 2011 Detective Daniel Sullivan charged Peter Hanvey, age 51, from West Side Avenue in Jersey City, NJ, with Forgery and Obtaining a Controlled Dangerous Substance by Fraud. Hanvey was charged as a result of information provided by Detective Jeff Malone of the Ocean Township Police Department.
Detective Malone had conducted an investigation into a fraudulent prescription that was presented to the C.V.S Pharmacy in Ocean Township. Det. Malone developed information that Hanvey had also passed a fraudulent prescription in the C.V.S Pharmacy located in the Navesink section of Middletown.
Detective Sullivan conducted a follow up investigation which resulted in Hanvey being charged. Hanvey was released on his own recognizance pending a court date.
On May 16, 2011 at approximately 5:35 am Patrolman Brady Carr and Patrolman Keith Hirschbein investigated a report of damage committed to numerous vehicles that occurred at the Eddie Coffey and Sons Construction Company located on Highway 36 in Middletown. The vehicles windows were smashed and tires slashed.
On May 16, 2011 Detective Sullivan was assigned to investigate the theft of a ladder from a residence on Wilson Avenue in Middletown. Detective Sullivan conducted an investigation which resulted in Terrance McQuillan, age 29, from Wilson Avenue in Middletown being charged with Theft.
McQuillan was processed and held on bail.
On May 17, 2011 at approximately 11:20 pm Patrolman Raymond Sofield responded to the area of the New Monmouth Diner, located on Highway 35 in Middletown in reference to an intoxicated subject who had called 9-1-1 numerous times. Officer Sofield located the subject, identified as Stephen Acquaviva, age 34, from Bonnie Drive in Middletown.
Patrolman Sofield determined that Acquaviva did not have an actual emergency and was repeatedly calling 9-1-1 because he was intoxicated. As a result of Officer Sofield’s investigation Acquaviva was arrested for Making False Public Alarms. He was transported to police headquarters where he was processed and released on a summons pending a court date.
On May 18, 2011 at approximately 9:50 am Patrolman Keith Hirschbein was on patrol in the area of the McMahon Park hockey rink when he observed a subject, identified as David Matheny, age 49, from Seaside Avenue in Keansburg, NJ, urinating in the dugout area of the rink.
Officer Hirschbein conducted an investigation which resulted in Matheny being arrested for Criminal Mischief. He was transported to police headquarters where he was processed and released on a summons pending a court date.
On May 18, 2011 at approximately 3:55 pm Patrolman Anthony Dellatacoma responded to the Sears Store on Highway 35 in reference to a shoplifting. Upon arrival store security advised the officer that they had observed Danielle Boyce, age 35, from Port Monmouth Road in Middletown, leave the store with $287.67 of unpaid merchandise. Security stopped Boyce in the parking lot and detained her until police arrived.
Officer Dellatacoma arrested Boyce and transported her to police headquarters where she was charged with Shoplifting. She was processed and released pending a court date.
On May 18, 2011 at approximately 5:50 am Patrolman John Soltysik and Patrolman Felipe Benedit responded to the area of Twin brooks Drive and Highway 35 in reference to a report of a white box truck that had been involved in the attempted burglary of a vehicle that had occurred in the parking lot of the Sears store.
The officers located the vehicle and conducted an investigation which resulted in the arrest of Bernard Kusakavitch, age 45, from Osborne Drive in Pittston, PA, being charged with Attempted Theft, Conspiracy, Obstruction and Hindering Apprehension. Police determined that Kusakavitch had attempted to steal Diesel fuel from a tractor trailer that was parked in the parking lot.
He was transported to police headquarters where he was processed and held on $40,000 bail. Detective William Strohkirch assisted with the investigation.
On May 19, 2011 at approximately 2:55 am Patrolman Brian McGrogan was on patrol in the area of Highway 35 when he observed a vehicle being driven without headlights. Officer McGrogan stopped the vehicle and approached the driver, identified as Christopher Haspilaire, age 21, from Portland Road in Atlantic Highlands, NJ, and detected an odor of an alcoholic beverage coming from his breath.
Officer McGrogan conducted an investigation which resulted in Hispilaire being arrested for Driving While intoxicated. He was transported to police headquarters where he was processed and released pending a court date.
On May 20, 2011 at approximately 3:35 am Corporal Richard Fusella responded to the area of Locust Point Road near the Rumson Bridge in reference to a driver of a vehicle asleep behind the wheel.
Upon arrival Corporal Fusella located the vehicle and approached the driver, identified as Alexander Heagney, age 18, from Clay Court in the Locust section of Middletown.
While speaking with Heagney, Officer Fusella observed a baggie of Marijuana in the vehicle. Heagney was placed under arrest and was transported to police headquarters where he was charged with Possession of under 50 grams of Marijuana. He was processed and released pending a court date.

Anthony Jones, age 26, from Veeder Avenue in Toms River, arrested on May 18, 2011 by Patrolman Michael Nolan on a Contempt of Court warrant issued by the Middletown Municipal Court. He was held on $500.00 bail.
Jeffrey Dressler, age 33, from Locust Road in Hazlet, NJ, arrested on May 18, 2011 arrested by James Beirne on a Contempt of Court warrant issued by the Middletown Municipal Court. He was released after posting $500.00 bail.
Amanda Rivera, age 30, from Kanes Lane in Middletown, NJ, arrested on May 18, 2011 by Patrolman Nicholas Fenezia on a Contempt of Court warrant issued by the Tinton Falls Municipal Court.

Pallone to Introduce Bill to Prevent Medicare Prescription Drug Abuse and Fraud
Washington, DC – Today, Congressman Frank Pallone, Jr. (NJ-06), Ranking Member of the House Energy and Commerce Subcommittee on Health announced that he is set to introduce legislation to address new reports of inappropriate payments for prescriptions of controlled substances in Medicare’s Part D program.
“Prescription drug abuse is an epidemic,” said Pallone. “Millions of Americans benefit from Medicare’s drug coverage program each year, which is why it’s imperative that checks are in place to prevent fraud and abuse as well as to protect patients. We cannot allow Medicare’s prescription drug program to be compromised at taxpayer expense. My bill, the Part D Prescription Drug Integrity Act of 2013, will strengthen the Medicare law to help address potential factors contributing to prescription drug abuse.”
Under Medicare Part D, the Centers for Medicare and Medicaid Services (CMS) contracts with private insurance companies, known as plan sponsors, to provide prescription drug coverage to beneficiaries who choose to enroll. Pallone’s bill would require plan sponsors to verify that a prescription for a drug on the Controlled Substances list was made by an authorized physician before paying for the drug. Under the current law, such a requirement does not exist.
The bill would also require plan sponsors to have drug utilization programs in place that would restrict access if there was credible evidence of beneficiaries abusing or diverting drugs. Most state Medicaid programs have utilization programs, but similar guidelines are not in place for most Part D beneficiaries. In addition, the bill will provide the Secretary of Health and Human Services (HHS) new tools to prevent the payment of claims by fraudulent prescribers or pharmacies.
Pallone wrote his bill on the heels of a HHS Office of Inspector General’s report released last month, which found that Medicare is paying for prescription drugs prescribed by unauthorized individuals including massage therapists, athletic trainers, social workers and interpreters. Given that tens of thousands of these drugs were controlled substances, the study’s findings raise questions about patient safety because of the potential for prescription drug abuse.
Prescription drug abuse has emerged as a serious and growing problem. According to the Centers for Disease Control and Prevention, more than 20,000 deaths occur each year due to the misuse and abuse of prescription drugs and one in 20 Americans say they have used prescription painkillers for non-medical reasons in the last year.

Crime Scene Middletown; Rx Fraud, Shoplifting and Theft Are A Few Highlights Of Recent Activities

On May 30, 2011 Detective First Class Daniel Sullivan conducted an investigation into a prescription fraud that occurred at the CVS Pharmacy in the Navesink section of Middletown. Detective Sullivan determined that Robert Pittius, age 31, from St. James Place in Keansburg, NJ, had forged a prescription blank for 120 Oxycodone pills and submitted it to the pharmacy.
Detective Sullivan located Pittius and arrested him on June 7, 2011. He was charged with Forgery and Receiving Stolen Property and was released pending a court date. Detective Sullivan was assisted by Detective Jason Lopez and Detective Sergeant Wayne Davis of the Keansburg Police Department.
On June 8, 211 at approximately 1:05 pm Patrolman Kevin Gardiner responded to the Sears Store in reference to a shoplifting. Upon arrival he was advised by store security that they had observed Lindsey Tweddle, age 27, from Huddy Avenue in Highlands, NJ, place over $400.00 worth of merchandise in her purse at which point she was detained.
Patrolman Gardiner placed Tweddle under arrest and transported her to police headquarters where she was charged with Shoplifting. The officer also located a Contempt of Court warrant issued by the Sayreville Municipal Court for her arrest. She was held on bail.
On June 10, 2011 Detective Kimberly Best arrested William Deppisch, age 23, from Campbell Avenue in Belford, NJ for Possession of Stolen Property as a result of an investigation into a burglary and theft of a dirt bike from a residence on Church Street in Belford that occurred on May 22, 2011.
Deppisch was processed and released pending a court date.
On June 11, 2011 at approximately 5:45 pm Patrolman Ryan Riffert responded to the Bottle King Liquor Store in reference to a report of a subject who tried to purchase alcohol with a fake driver’s license. The officer conducted an investigation which resulted in Scott Jagarnauth, age 19, from Swimming River Road in Lincroft, NJ, being arrested for Misrepresenting his age to purchase alcohol.
Police say Jagarnauth used a fake Rhode Island driver’s license to attempt to buy the alcohol. He was processed and released pending a court date.
On June 11, 2011 at approximately 9:30 pm Patrolman McNair was on patrol in the area of Myrtle Avenue when he observed a suspicious vehicle parked on the side of the road. Officer McNair approached the vehicle to speak with the occupants at which point he detected the odor of burnt Marijuana coming from inside the car.
Patrolman McNair conducted an investigation which resulted in the arrests of Elizabteh Tepper, age 20, from Georgia Avenue in Port Monmouth, NJ; Steven Mago, age 20, from Church Street in Belford,NJ and Alana Fiorella, age 19, from Wood Avenue in Port Monmouth, NJ. All three subjects were charged with Possession of under 50 grams of Marijuana and were processed and released pending a court date.
On June 12, 2011 at approximately 1:25 pm Corporal Daniel Murdoch responded to the area of Lillian Place in reference to a suspicious vehicle. Upon arrival Officer Murdoch approached the vehicle to speak with the occupants at which point he detected a strong odor of Marijuana coming from the car.
Corporal Murdoch conducted an investigation which resulted in the arrest of a 16 juvenile from Andover Street being arrested for Possession of a Prescription legend drug. He was transported to police headquarters where he was processed and released to his guardian.
On June 13, 2011 at approximately 2:15 pm Patrolman Robert Shannon responded to Middletown High School North in reference to a student found in possession of a controlled dangerous substance. Upon arrival Officer Shannon was advised by an assistant principal that a 17 year old male student had been found in possession of a Marijuana pipe and Vicoden.
Officer Shannon arrested the juvenile who was transported to police headquarters where he was processed and released to his father.
On June 13, 2011 Detective Laurence Schachtel arrested Corey Ozelas, age 24, from Campbell Avenue in Port Monmouth, NJ, and a 16 year old male juvenile, also from Campbell Avenue, for Burglary, Theft and Criminal Mischief, as a result of an investigation in reference to a burglary that occurred at a residence on Campbell Avenue on May 16, 2011 during which jewelry and electronic items were stolen.
The 16 year old juvenile was also charged with Criminal Mischief, Burglary and Theft to another residence located on Church Street in Belford that occurred on May 22, 2011.
Ozelas was held on $35,000.00 bail with no 10% option set by Judge Richard Thompson and the juvenile was released to his mother pending a court date.

Patrolman Stephen Greenwood arrested a 17 year old female juvenile June 7, 2011 on a Contempt of Court warrant issued by the Middletown Municipal Court. She was released after posting $250.00 bail.
Stephen Casper, age 48, from Leonardville Road, arrested on June 7, 2011 by Patrolman John Mele on a Contempt of Court warrant out of Bradley Beach Municipal Court. He was released on his own recognizance.
Marcos Varela Serrano, age 25, from East Sunset Avenue in Red Bank, NJ arrested on June 8, 2011 by Patrolman Stephen Greenwood on a Contempt of Court warrant issued by the Long Branch Municipal Court. He was released after posting $300.00 bail.
David Gonzalez, age 65, from Burlington Avenue in Leonardo, NJ, arrested on June 8, 2011 by Patrolman Stephen Greenwood on a Contempt of Court warrant issued by the Middletown Municipal Court. He was released after posting $500.00 bail.
Harold Johnson, age 29, from Harbor Way in Middletown, arrested on June 8, 2011 by Patrolman Keith Hirschbein on two Contempt of Court warrants issued by the Middletown Municipal Court. He was released after posting bail.

Crime Scene Middletown: It Was Another Busy Week As "MIDDLETOWN TOWNSHIP POLICE REPORT RECENT ACTIVITY"

On March 31, 2011 Detective Daniel Sullivan was contacted by Detective Jeff Miller of the Hazlet Police Department in reference to a prescription fraud investigation he had conducted. Det. Miller informed Det. Sullivan that Joan Heary, age 48, from Edgewood Road in Matawan, NJ, had presented fraudulent prescription blanks at numerous pharmacies throughout the area to include the Walgreens and Rite Aid pharmacies in Middletown.
Detective Sullivan conducted a follow up investigation which revealed Heary had presented fraudulent prescriptions for Roxicodone and Oxycontin at the two pharmacies on four different dates.
Det. Sullivan arrested and charged Heary with Forgery and Obtaining a Controlled Dangerous Substance by Fraud. She was processed and released on a summons pending a court date.
On March 31, 2011 at approximately 2:20 pm Police Officer Larisa Doriety responded to Middletown High School North in reference to a sixteen year old student who was found to be in possession of Marijuana and a soda can which was converted into a device used to smoke Marijuana.
Officer Doriety arrested the female student who was transported to police headquarters where she was charged with Possession of under 50 Grams of Marijuana and Possession of Drug Paraphernalia.
The student was processed and released to her father pending a court date.
On April 1, 2011 at approximately 12:10 am Patrolman Christopher Dee and Sgt. James Prosinski responded to the area of Leonardville Road and Avenue D in reference to a report of a one car motor vehicle accident. Upon arrival the officers located a vehicle with substantial damage to the driver’s side door and the driver, identified as Amanda Laguardia, age 25, from Atlantic Street in Highlands, NJ, in the driver’s seat.
The officers conducted an investigation which resulted in Laguardia being charged with Driving While Intoxicated and Reckless Driving. She was released on summonses pending a court date.
On April 1, 2011 at approximately 5:10 am Patrolman Donald Coates and Patrolman Felipe Benedit responded to the area of Wilson Avenue in reference to a vehicle parked in a parking lot with a man passed out behind the wheel.
Upon arrival the officers located Daniel Price, age 23, from Georgia Avenue, in Port Monmouth, unresponsive and sitting in the driver’s seat. Mr. Price regained consciousness after a brief period.
The officers conducted an investigation which resulted in Price being arrested and charged with Possession of Oxycodone, Possession of Xanax, Possession of a Hypodermic Syringe and Possession of Drug Paraphernalia.
Price was processed and held on $12,500.00 bail with no 10% option set by Judge Richard Thompson.
On April 1, 2011 at approximately 4:10 pm Patrolman James Beirne and Patrolman Kevin Gardiner responded to the area of Brookside Drive in reference to a suspicious vehicle possibly involved in the distribution of narcotics.
Upon arrival the officer located the vehicle as it was leaving the area. The officers conducted an investigation which resulted in a seventeen year old passenger being arrested and charged with Possession of under 50 Grams of Marijuana. The male juvenile was transported to police headquarters where he was processed and released to his mother pending a court date.
On April 1, 2011 at approximately 7:00 pm Patrolman Richard Fulham and Patrolman Albert Scott responded to the McDonalds restaurant located on Highway 35 in reference to a report of two male subjects possibly distributing narcotics.
Upon arrival the officers located the two male subjects sitting in a vehicle in the parking lot.
The officers approached the vehicle and immediately detected a strong odor of raw marijuana coming from inside the car. The officers conducted an investigation which resulted in the recovery of a large amount of marijuana, the seizure of $476.00 in currency and the seizure of the vehicle, a white Volvo.
As a result of the investigation the officers arrested Arthur Mathurin, age 19, from Abbey Road and Rashon Martin, age 22, from Brainard Avenue.
Mathurin was charged with Possession with the intent to distribute over 50 grams of marijuana, Possession with the intent to distribute a controlled dangerous substance within 500 feet of Tindall Park, Possession of over 50 grams of marijuana and Possession of a controlled dangerous substance in a motor vehicle. He was held on $15,000 bail with no 10% option set by Judge Richard Thompson.
Martin was charged with Possession with the intent to distribute over 50 grams of marijuana, Possession with the intent to distribute a controlled dangerous substance within 500 feet of Tindall Park, and Possession of over 50 grams of marijuana. He also had a Contempt of court warrant out of Middletown Municipal Court. He was held on $15,250 bail with no 10% option set by Judge Richard Thompson.
On April 2, 2011 at approximately 2:45 am Patrolman John Mele was on patrol in the area of Navesink River Road when he observed a vehicle weaving in and out of its lane of travel. Patrolman Mele stopped the vehicle and approached the driver, identified as Jeremy Schreiber, age 21, from Baskenridge Drive.

James Prosinski responded to the area of Leonardville Road and Avenue D in reference to a report of a one car motor vehicle accident. Upon arrival the officers located a vehicle with substantial damage to the driver’s side door and the driver, identified as Amanda Laguardia, age 25, from Atlantic Street in Highlands, NJ, in the driver’s seat.
The officers conducted an investigation which resulted in Laguardia being charged with Driving While Intoxicated and Reckless Driving. She was released on summonses pending a court date.
On April 1, 2011 at approximately 5:10 am Patrolman Donald Coates and Patrolman Felipe Benedit responded to the area of Wilson Avenue in reference to a vehicle parked in a parking lot with a man passed out behind the wheel.
Upon arrival the officers located Daniel Price, age 23, from Georgia Avenue, in Port Monmouth, unresponsive and sitting in the driver’s seat. Mr. Price regained consciousness after a brief period.
The officers conducted an investigation which resulted in Price being arrested and charged with Possession of Oxycodone, Possession of Xanax, Possession of a Hypodermic Syringe and Possession of Drug Paraphernalia.
Price was processed and held on $12,500.00 bail with no 10% option set by Judge Richard Thompson.
On April 1, 2011 at approximately 4:10 pm Patrolman James Beirne and Patrolman Kevin Gardiner responded to the area of Brookside Drive in reference to a suspicious vehicle possibly involved in the distribution of narcotics.
Upon arrival the officer located the vehicle as it was leaving the area. The officers conducted an investigation which resulted in a seventeen year old passenger being arrested and charged with Possession of under 50 Grams of Marijuana. The male juvenile was transported to police headquarters where he was processed and released to his mother pending a court date.
On April 1, 2011 at approximately 7:00 pm Patrolman Richard Fulham and Patrolman Albert Scott responded to the McDonalds restaurant located on Highway 35 in reference to a report of two male subjects possibly distributing narcotics.
Upon arrival the officers located the two male subjects sitting in a vehicle in the parking lot.
The officers approached the vehicle and immediately detected a strong odor of raw marijuana coming from inside the car. The officers conducted an investigation which resulted in the recovery of a large amount of marijuana, the seizure of $476.00 in currency and the seizure of the vehicle, a white Volvo.
As a result of the investigation the officers arrested Arthur Mathurin, age 19, from Abbey Road and Rashon Martin, age 22, from Brainard Avenue.
Mathurin was charged with Possession with the intent to distribute over 50 grams of marijuana, Possession with the intent to distribute a controlled dangerous substance within 500 feet of Tindall Park, Possession of over 50 grams of marijuana and Possession of a controlled dangerous substance in a motor vehicle. He was held on $15,000 bail with no 10% option set by Judge Richard Thompson.
Martin was charged with Possession with the intent to distribute over 50 grams of marijuana, Possession with the intent to distribute a controlled dangerous substance within 500 feet of Tindall Park, and Possession of over 50 grams of marijuana. He also had a Contempt of court warrant out of Middletown Municipal Court. He was held on $15,250 bail with no 10% option set by Judge Richard Thompson.
On April 2, 2011 at approximately 2:45 am Patrolman John Mele was on patrol in the area of Navesink River Road when he observed a vehicle weaving in and out of its lane of travel. Patrolman Mele stopped the vehicle and approached the driver, identified as Jeremy Schreiber, age 21, from Baskenridge Drive.
