Letter: Ocean County Prosecutors Should Prosecute Over Twitter Threat

Dear Editor,

I was horrified to learn that the Ocean County Prosecutors Office will not be criminally charging Jill McGuinness of Jackson NJ, for making threats over Twitter to bomb Jewish residents of Lakewood and run them over with her car.

The fact her father is New Jersey State Trooper Steve McGuinness seems to be the reason she is avoiding criminal prosecution. The NJSP has previously admitted to racially biased policies.

Ocean County Prosecutor Joseph Coronato should be fired for his professional incompetence and corruption in refusing to prosecute this aspiring Nazi terrorist.

I call upon the FBI to begin a federal investigation into the matter.

If the FBI fails to act, Mossad should capture her and hold her in detention in Israel to protect the Jewish community.

I feel it should be a crime to make death threats using any means, But apparently this is not a crime. You should not hope that foreign intelligence organizations violate our national sovereignty. If that is allowed the Iranians would be kidnapping US citizens for speaking about the truth about Mohammed.
If you want laws that make sense stop voting for Liberals! And stop smoking that stuff!

Mike, we respectfully disagree. There were and are corrective actions being taken in this case, however because this is a juvenile matter we are by law unable to provide any specific details regarding this case or our response. Further, the Juvenile Justice statutes are rehabilitative not punitive. No juvenile under these same circumstances would ever be given a jail sentence. We do appreciate your concern. This was not a matter to be taken lightly, however we are not guided by public opinion. Our department must have the courage to dispense justice solely within the legal statutes of our state and the full consideration of a persons first amendment rights - Al Della Fave.

Respectfully, you're trying to do PR spin because Mr. Hafner caught your agency doing something wrong and you know it.

You are a former NJSP employee so you are personally biased in favor of the agency, which is biased against minorities. Are you forgetting about State v Soto?

Her dad NJSP Trooper Steve McGuiness should face disiplinary actions for allowing his uniform to be misused for nazis photos. Clearly the apple doesn't fall far from the tree.

If someone were to found to have posted the following hypothetical tweets, they would be in jail.

Hypothetical Example 1: "I want to take my car and run over Ocean County Prosecutors Office Employees" (not an actual tweet or message - for comparison only)

Hypothetical Example 2: "A picture of the Ocean County Prosecutors Office building and a photo, with the caption perfect bombing time" (not an actual tweet or message - for comparison only)

If either of those two hypothetical examples were tweeted by someone, you know they'd be in jail for a long time.

Yet just replace those law enforcement references with jews and give the person posting the tweet a NJSP trooper father they're off scot free.

The rules that apply to normal citizens don't apply to the arrogant assholes who are the relatives of NJ cops.

Al Della Fave, either you're a total idiot who in your entire law enforcement career failed to study the 2C code or you're just a horrible liar.

If Jill McGuiness thinks nazis are so cool, then maybe she should get shoved into an oven or gas chamber? There are the relatives of 6 million murder victims who would love to see that happen.

Law is one area you won't beat the NJ Jewish community on, cupcake.

Word to the wise: Reconsider your position and file charges.

Otherwise someone will end up taking matters into their own hands and your office may not like the outcome.

2C:12-3. Terroristic threats.

a.A person is guilty of a crime of the third degree if he threatens to commit any crime of violence with the purpose to terrorize another or to cause evacuation of a building, place of assembly, or facility of public transportation, or otherwise to cause serious public inconvenience, or in reckless disregard of the risk of causing such terror or inconvenience. A violation of this subsection is a crime of the second degree if it occurs during a declared period of national, State or county emergency. The actor shall be strictly liable upon proof that the crime occurred, in fact, during a declared period of national, State or county emergency. It shall not be a defense that the actor did not know that there was a declared period of emergency at the time the crime occurred.

Mr. Della Fave: the same 2C criminal code applies to juvenile acts of deliquency as it does to adult indictable and disorderly persons offenses. The girl is a threat to the community so your office failed in it's obligation to protect the public. Senator Menendez thinks so too. As an attorney and former municipal prosecutor in New Jersey, I disagree with your assessment and it seems like your office is trying to do damage control on a coverup for the NJSP.

Senator Menendez has now called for a federal investigation by the Justice Department (the FBI's umbrella agency) into this matter. Good letter Mr. Hafner, you brought up a good point and I don't think the Prosecutor's Office likes being held accountable. This was wrong and she should have been arrested.

Al, As a possible Ocean County juror, I would welcome Mossad coming to Jackson and will not convict anyone who takes action against mini Hitler. There are many more other possible jurors like me. We would lie to your face at jury selection and then let anyone acting in anger over this walk free.

I'm not the person that you should reaching out to in this instance. I don't have the time to "investigate" allegations of wrongdoings by the Ocean County Prosectors office.

If you have something you want to pass on for posting submit it as a letter to this blog. I would also suggest sending whatever you have to thejerseyshoreinsider@gmail.com. I'm sure they'd be very interested.
