Congressman Frank Pallone's Statement on Supreme Court Ruling to Uphold the Affordable Care Act

Thursday, June 28, 2012

WASHINGTOND.C.—Congressman Frank Pallone, Jr. (NJ-06), Senior Democrat on the U.S. House Energy and Commerce Committee’s Health Subcommittee and a primary author of Affordable Care Act released the following statement upon the U.S. Supreme Court ruling to uphold the landmark law:

“Today is a great day for the American people.  The Supreme Court’s decision to uphold the Affordable Care Act (ACA) reaffirms our nation’s commitment to make sure that all Americans have access to quality affordable health care and health insurance. 

“For the millions of Americans who have gone without health insurance, the seniors who have struggled due to inadequate coverage, the women, children and young adults that have been denied coverage for preexisting conditions, the Court’s ruling is not only a victory, but a validation that they deserve to have the most basic of human needs met—access to health care.

“The ACA addressed so many of the gaps in the American health care system from closing the Medicare Part D ‘donut hole,’ to stopping the practice of denying those with preexisting conditions insurance coverage, to claiming womanhood as a preexisting health condition, to allowing young adults to stay on their parents’ coverage.  This law has changed the way our country manages and delivers all phases of our health care system and I am proud to have been a part of its creation and prouder still today to learn of the Court’s decision to uphold its constitutionality.”

Kudos to Justice Roberts for helping to retore at least the perception of intellectual integrity on the Supreme Court.

I just had my first " run in" with this act via Horizon. I took my kids for thir annual well check ups nd was told by Horizon this was a "no deductible" visit. The dr. Filled out their school forms and we left. Just got the bill. Much of what was always covered as part of the well visit was denied with the insurer blaming it on the new "obamacare" rules. I am now paying much more than my co- pay would have even been ( i am paying Almost 75 per child for uncovered items). My husband is unemployed, we pay for our own policy out of pocket. Seems to not benefit my circumstance.

Anon 1:28- Can you please enlighten us on what part of your child's well visit was denied when it was your understanding it was covered and how Horizon cited "Obamacare" as the reason.?

I think using the law of the land as a reason to deny coverage is actionable and appealable. Such drivel from an insurance company is exhibit A as to why our healthcare needs to be removed from the grip of "for profit" entities.

Doubt the validity of the above since the now validated law stresses the need for preventive care.

Medicare now pays in full for one yearly physical exam for it's insured and pays for it without the patient meeting any deductible beforehand.

Maybe this doctor or his billing company doesn't understand . Sounds like a good case for an appeal of this doctor's action or failure to file the claim on behalf of this family.

My premium has not gone up and co-pays are the same. My well visits are free. If people are finding increases then something is wrong.

I have Oxford/United. Nothing has changed. Free well visits and 10% co-pay.
The scare tactics from the right wing are just that. No death pannels and the government is not telling you what doctor you can go to.
When all the parts are implemented people will realize this is a good thing and ultimately bring down costs.

If the Health insurers are citing Obamacare as the reason they are raising rates and/or reducing coverage, perhaps they would like to tell us why they have been doing precisely the same thing for decades, long before Obama was even in office. We're waiting Aetna, United Healthcare, Horizon ........
